Mental Capacity Act (MCA)

What is the Mental Capacity Act?

The MCA’s main purpose is to allow individuals (“donors”) to plan ahead and appoint someone (“donees”) to make important decisions for them in the event they lose mental capacity.

According to the act, persons who lack mental capacity are defined as “unable to make a decision for himself in relation to the matter because of an impairment of, or a disturbance in the functioning of, the mind or brain”. Types of mental incapacity can be permanent, temporary, or fluctuating.

Appointment of donee(s):

Persons with mental capacity can voluntarily make a Lasting Power of Attorney (LPA), appointing one or more persons, as donee(s), to make decisions on their behalf if and when they lose mental capacity. A donee may be appointed for matters relating to the person’s personal welfare, and/or his property and affairs. With the exception of psychiatrists, all medical practitioners need to be accredited by the Public Guardian to be a ‘certificate issuer’ to certify that the person has the capacity to make the LPA. This can be done by attending a prescribed course, which is available online at the Singapore Medical Association’s website.

Appointment of a deputy:

In cases where an LPA was not made before the loss of mental capacity, the MCA allows a deputy to be appointed by the court to make decisions on behalf of the person (P). A deputy can be appointed for matters regarding personal welfare, and/or property and affairs. The individual applying to become P’s deputy is usually a relative or close friend.

The application to appoint a deputy will ask the court to: 

  1. make a declaration that P lacks the mental capacity to make decisions in matters relating to his personal welfare and/or property and affairs
  2. make an order for the applicant to be appointed as P’s deputy for his personal welfare and/ or property and affairs
  3. make orders regarding the scope of the deputy’s powers. 

A medical report is needed to assist the court in making the decision on P’s mental capacity. It is a legal requirement for the report to be exhibited in a doctor’s affidavit accompanying the deputy application.

受赠人的任命

具有心智能力的人可以自愿制定持久授权书 (LPA),指定一名或多名人员作为受赠人,在他们失去心智能力时代表他们做出决定。 可以指定受赠人处理与个人福利和/或其财产和事务有关的事宜。 除精神科医生外,所有执业医师都需要获得公共监护人的认可,成为“证书颁发者”,以证明该人有能力制定 LPA。 这可以通过参加规定的课程来完成,该课程可在新加坡医学协会的网站上在线获取。

任命副手

如果 LPA 不是在丧失心智能力之前做出的,MCA 允许法院任命一名代理人代表该人 (P) 做出决定。 可以任命代表处理有关个人福利和/或财产和事务的事务。 申请成为 P 代理人的人通常是亲戚或密友。

任命代理人的申请将要求法院:

  1. 声明 P 缺乏在与其个人福利和/或财产和事务有关的事项上做出决定的心智能力
  2. 为申请人的个人福利和/或财产和事务作出命令,任命申请人为 P 的代理人
  3. 就代表的权力范围作出命令

需要一份医疗报告来协助法院对 P 的心智能力做出决定。 根据法律要求,该报告必须在副手申请随附的医生宣誓书中出示。
